Public Notice Legal Notice Of Public Hearing The Indiana Department of Transportation will hold a public hearing on Thursday, December 13, 2012, at 6:00pm in the East Jay Middle School Cafeteria, 225 East Water Street, Portland, Indiana 47371. The purpose of the public hearing is to offer all interested persons an opportunity to comment on current design plans for the proposed State Road (SR) 26, locally know as East Water Street, pavement replacement project from US 27 (Meridian Street) to 0.78 miles east of US 27, through the City of Portland located in Jay County. The total project length is about 0.64 mile. This project does not include the bridge over the Salamonie River. The proposed improvements to this project include full-depth pavement replacement with new curb and gutter, sidewalks, drive approaches, replacing the outdated and undersized storm sewer, and improving intersection turning movement. There will be incidental construction on both ends of the project along with a slight curve correction in the area of the Garfield Street intersection. The proposed storm sewer system will contain road inlets and manholes with dual trunklines under each travel lane of SR 26, and will empty into the Salamonie River at the south end of Garfield Street. Construction of the project will require approximately 0.63 acre of new permanent right-of-way. No displacement of residents or businesses will be involved with this project. Local access to all residences, schools and businesses along SR 26 will be maintained at all times during the construction phase using side streets, temporary entrances or other appropriate means. SR 26 will be closed to through traffic during construction using the official state detour over state-maintained routes, using portions of US 27, SR 67, and Ohio SR 49. The project will require the use of approximately 0.2 acre of property at the Weiler Wilson Park that belongs to the City of Portland. The sewer easement would pass between two baseball diamonds that are open to the public. The placement of the sewer would not adversely impact the activities, features or attributes that qualify the property for protection under Section 4(f) of the Department of Transportation Act of 1966 and in accordance with SAFETEA-LU Section 6009(a). As such, it is the intent of INDOT, along with the Federal Highway Administration to issue a finding of de minimis. In accordance with SAFETEA-LU Section 6009 (a), the views of the public are being sought regarding the effect of the proposed project on the public recreation area. The tentative timetables for right-of-way acquisition and construction will be discussed during the formal presentation. Public statements for the record will be taken after the presentation. Individuals interested in participating in the public statement session may sign the speaker’s schedule prior to the presentation. All comments collected before, during and for a period of two (2) weeks after the hearing will be evaluated and addressed in the final design study report. The preliminary plans will be available for anyone interested in talking to the engineers about the project before and after the formal presentation.
