Public Notice Public Hearing Notice of Amendments/ Additions to the City of Portland Ordinances Concerning the Zoning Ordinance & Subdivision Control Ordinance The City of Portland Plan Commission hereby gives notice of a meeting to be held on October 3, 2013, at 5:00 pm in the Conference Room of the Community Resource Building, 118 S Meridian Street, Portland, Indiana, to consider the following proposed amendments/additions to the City of Portland Zoning Ordinance and Subdivision Control Ordinance. The amendments/additions in their entirety may be examined in the Plan Commission Office, Jay/Portland Building and Planning Department, 118 S Meridian Street, Suite E, Portland, Indiana, 47371, Monday through Friday from 8:30 am to 4:30 pm. Persons may offer an oral opinion at the hearing or submit written comments to the Plan Commission Office ten (10) days prior to the hearing. The hearing may be continued thereafter to a future date. Addition of Section 3.16 Airport Overlay District to the City of Portland Zoning Ordinance: Overview: 3.16 Airport Overlay District The Airport Overlay Zoning District (AO) shall include all zones as indicated on the Portland Municipal Airport Airspace Plan, which is a part of this ordinance and incorporated herein by reference. All land so indicated is hereby zoned and classified as the Airport Overlay Zoning District. Purpose and Intent It is hereby found that an airport hazard has the potential for endangering the lives and property of users of Portland Municipal Airport, and property or occupants of land in its vicinity; that an airport hazard may affect existing and future instrument approach minimums of Portland Municipal Airport; and that an airport hazard may reduce the size of areas available for the landing, takeoff, and maneuvering of aircraft, thus tending to destroy or impair the utility of Portland Municipal Airport and the public investment therein. Accordingly, it is declared: A. that the creation or establishment of an airport hazard has the potential of being a public nuisance and may injure the region served by the Portland Municipal Airport; B. that it is necessary in the interest of the public health, public safety, and general welfare that the creation or establishment of airport hazards be prevented; and C. that the prevention of the creation or establishment of hazards to air navigation, the elimination, removal, alteration or mitigation of hazards to air navigation, or marking and lighting of obstructions are public purposes for which a political subdivision may raise and expend public funds and acquire land or interests in land.
