Felony court news

OWI sentence
A Bluffton man was sentenced recently in Jay Superior Court.
Douglas Yetter, 58, pleaded guilty to operating a vehicle while intoxicated, as enhanced to a Class D felony, and was sentenced July 23 to 18 months in Jay County Jail, with all but 72 days suspended. As part of a plea agreement, a count of operating a vehicle with an alcohol concentration equivalent of 0.15 percent or more was dismissed.
He was given 72 days credit for 36 days served and was assessed court costs of $168.50. He was ordered to pay a $200 drug and alcohol countermeasures fee and a $400 substance abuse program fee. He was placed on formal probation for 15 months, and the court recommended Indiana Bureau of Motor Vehicles suspend his driving privileges for one year, which began pre-conviction on April 7.

Possession sentence
A Ridgeville man was sentenced recently in Jay Superior Court.
Ethan Allen II, 48, pleaded guilty to possession of marijuana, a Class D felony, and was sentenced July 23 to 18 months in Jay County Jail, with all but 30 days suspended. As part of a plea agreement, counts of possession of a controlled substance and carrying a handgun without a license were dismissed.
He received four days credit for two days served and will serve the remaining 26 days of his sentence on electronically monitored home detention. He was assessed court costs of $168 and ordered to pay a drug abuse, prosecution, interdiction and correction fee of $200. He was ordered to pay a substance abuse program fee of $400 and placed on formal probation for 17 months.

Probation violation
A Dunkirk woman was recently found in violation of her probation in Jay Superior Court.
Alicia Moore, 25, was sentenced to an additional 150 days of the 18 month sentence originally imposed in the November case of unlawful possession of a syringe, a Class D felony, after she tested positive for opiates without a prescription in April and May.
She was given 124 days credit for 62 days served and began serving the remaining 26 days of her sentence July 23.

Trial set
A Portland man had two separate trials set recently in Jay Circuit Court.
Andy Ashley, 33, is charged with two counts of dealing in methamphetamine, both Class B felonies, and one count of conspiracy to commit dealing in methamphetamine, a Class B felony, after allegedly receiving pseudoephedrine from a confidential informant, allegedly engaging in several conversations about manufacturing methamphetamine and allegedly delivering methamphetamine in October 2012.
His two-day jury trial will begin at 8:30 a.m. Oct. 23
A two-day jury trial has also been set in a separate case involving Ashley.
He’s been charged with dealing in a schedule III controlled substance and dealing in methamphetamine, both Class A felonies, after allegedly delivering more than 300 mg of dihydrocodeinone at Katelynn Place Apartments in September 2012 and allegedly delivering methamphetamine within 1,000 feet of Youth Service Bureau in October 2012.
A trial has been set for 8:30 a.m. Nov. 13.

Dealing sentence
A Portland man was recently sentenced in Jay Circuit Court.
Isaiah Martyne, 23, pleaded guilty to dealing in a schedule II controlled substance, a Class B felony, and was sentenced July 25 to 10 years in Indiana Department of Correction. As part of a plea agreement, a count of dealing in a schedule II controlled substance, a Class A felony, was dismissed.
He was given credit from his date of arrest on Feb. 4 and assessed court cots of $168. He was ordered to pay a $200 drug abuse prosecution, interdiction and correction fee and pay $64 in restitution to Portland Police Department.
Martyne was also sentenced in a separate case.
He pleaded guilty to aiding, inducing or causing dealing in methamphetamine, a Class B felony, and was sentenced July 25 to 10 years in Indiana Department of Correction, to be served concurrently to the sentence imposed in the January case of dealing in a schedule II controlled substance.
He was given credit from his date of arrest on April 25 and was assessed court costs of $168 and ordered to pay a $200 drug abuse prosecution, interdiction and correction fee. He was also ordered to pay $84 in restitution to Portland Police Department.

Trial rescheduled
A Portland man had his trial postponed recently in Jay Circuit Court.
Robert Curtis, 25, is charged with aiding, inducing or causing dealing in methamphetamine, a Class B felony. His original two-day trial was set for July 28, but attorneys asked for a delay as amended paperwork changed information on when he allegedly committed the acts from Dec. 17 to sometime between June 22 and Dec. 17. His attorney claimed the amendment was a “substantial and prejudicial change”.
His two-day jury trial has been rescheduled for 8:30 a.m. Sept. 18.

Trial scheduled
A Dunkirk man had his trial set recently in Jay Circuit Court.
Robert Bell, 28, is charged with two counts of dealing in a schedule III controlled substance, both Class B felonies, after allegedly delivering dihydrocodeinone in September 2012 and August 2013.
His two-day jury trial will begin at 8:30 a.m. Oct. 16.

Dealing sentence
A Portland man was sentenced recently in Jay Circuit Court.
Dustin Journay, 29, pleaded guilty to dealing in methamphetamine, a Class B felony, and was sentenced July 23 to 10 years in Indiana Department of Correction.
He was given credit from his date of arrest on Feb. 3, less 20 days loss of good time credit. He was assessed court costs of $168 and ordered to pay a $200 drug abuse prosecution, interdiction and correction fee.
