Ethanol suit in court

A pretrial hearing was expected to be held last week in a lawsuit filed against Mercer Energy and a local zoning appeals board.

The suit was filed by several Mercer County residents concerned with what took place during a zoning appeals meeting. During the meeting, board members voted to allow a height variance, allowing Mercer Energy to build an ethanol plant east of Celina, Ohio, on Four Turkey Road.

The lawsuit contends that zoning board chairman, Jonny Dicke, should not have overseen the board meetings because of a conflict of interest.

The meetings took place between December 2007 and January 2008.
