Felony court news

Requests denied

Requests made by a Pennville man accused of having a methamphetamine lab at his home were denied this week in Jay Circuit Court.

Jason Brown, 37, is facing charges of attempted dealing in methamphetamine, a class B felony, and possession of chemical reagents or precursors with intent to manufacture a controlled substance, a class D felony.

He appeared for an initial hearing Tuesday and asked for a change of judge and for his case to be dismissed. Both requests were denied.

His pretrial hearing is scheduled for Aug. 2 at 9:30 a.m.

On May 19, police went to his home to arrest him for violating the conditions of his parole. Police allegedly found items used to make methamphetamine.

Sentenced for possession

A Redkey man's guilty plea recently was accepted in Jay Superior Court.

Anthony A. Neely, 26, pleaded guilty to possession of a controlled substance, a class D felony. He was sentenced May 26 to two years in the Jay County Jail, with all but 11 months suspended and five months credit for time served. The remaining six months will be served on electronically monitored home detention.

He was fined $100 and ordered to pay $164 in court costs, a $200 drug abuse, prosecution, interdiction and correction fee and a $400 jay Superior Court Substance Abuse Program fee. He was placed on probation for one year.

He was arrested March 12 by Jay County police who stopped him on suspicion of being involved in a possible drug transaction in Redkey. He had a prescription medication not prescribed to him.

Also, a charge of possession of marijuana, a class D felony, was dismissed May 27. He was accused of possessing marijuana on Nov. 8, 2009, while he was an inmate at the Jay County Jail.

A notice to seek habitual substance offender status for Neely was dismissed May 27.

Modification denied

A Liberty Center man's request to have his sentence modified was denied May 28 in Jay Circuit Court.

Darrell L. Weaver, 30, asked to serve his remaining sentence on probation or electronically monitored home detention.

Weaver currently is serving a sentence for the crime of possession of marijuana, a class D felony. He was sentenced Feb. 3, 2009, to three years in the Indiana Department of Correction, with six days credit for time served.[[In-content Ad]]
