New hearing officer named for complaint by teachers

An unfair labor practice filed against the South Adams School Corporation will go before another state hearing examiner for consideration.

South Adams Classroom Teachers Association president Jody Walker said that she was notified on Monday that a three-member panel from the Indiana Education Employment Relations Board has ruled that SACTA’s claim will be reassigned to another hearing examiner. The hearing examiner will review all of the paperwork for the claim filed by SACTA and depositions from both sides.

This ruling came after the previous hearing examiner has been reviewing the case since association members filed a notice of intent for a unfair labor practice on Feb. 23, 2005.

“It means that they are throwing it out and are going to give it to another examiner,” Walker said Monday afternoon, adding that she was unsure why IEERB took this action.

The unfair labor practice filed by the SACTA stems from the school corporation changing teacher’s health insurance about three years ago without negotiating with association members, Walker said. These changes caused insurance deductibles and copays to increase and changed benefits.

Soon after these insurance changes, negotiating began for the teacher’s contract. Negotiations continue today and the SACTA has worked without a contract for almost three years.

The school corporation’s negotiating team includes school board members Julie Mansfield, Steve Dobler and Denny Affolder and the board’s attorney from Elkhart.

The association’s negotiating team includes Walker, Steve Tatman and Sylvia Lawson and Indiana State Teachers Association representative Jack Groch of Fort Wayne.

A mediator, appointed by IEERB, is also present at mediation between the two groups, which last met on April 5. During this mediation, the school corporation’s negotiating team met in one room and the association’s negotiating team met in another room with the mediator “running between both rooms,” Walker said.

“We are more than willing to go back to mediation at any time and meet face to face. The mediator said she would just let us (talk),” Walker said. “We have notified the mediator that we are ready to go back (to mediation) this summer.”

Someone from the school corporation or the corporation’s negotiating team will also have to contact the mediator to set up a time for both groups to meet.[[In-content Ad]]
