Sentenced
for dealing
A rural Portland man recently was sentenced to prison time for selling morphine to a police informant.
Calvin Wyatt, 44, pleaded guilty in Jay Circuit Court to dealing in a schedule II controlled substance, a class B felony.
His guilty plea was accepted Nov. 29 and he was sentenced to 15 years in the Indiana Department of Correction, with nine years suspended and two days credit for time served. He was ordered to pay $164 in court costs and was ordered to pay a $200 drug abuse, prosecution, interdiction and correction fee. He was ordered to pay $630 in restitution to the Tri-County Drug Task Force
Two counts of dealing in a schedule II controlled substance were dismissed as part of a plea agreement in the case.
On Oct. 1, 2009, he sold morphine to a police informant.
Sentenced for lab
A Redkey man has been sentenced to prison time for operating a methamphetamine lab at his home.
Bobby L. Hensley Jr., 38, pleaded guilty to dealing in meth, a class B felony.
His guilty plea was accepted Nov. 18 and he was sentenced in Jay Circuit Court to 20 years in the Indiana Department of Correction, with nine years suspended and credit for time served since Jan. 13.
He was ordered to pay $164 in court costs and a $200 drug abuse, prosecution, interdiction and correction fee. He was placed on probation for nine years.
Charges of possession of chemical reagents, a class D felony and resisting law enforcement, a class A misdemeanor, were dismissed. He was arrested Jan. 13.
Sentenced for forgery
A Portland woman has been sentenced to prison time for writing a prescription for herself and having it filled.
Chrissy Nichols, 32, pleaded guilty to forgery, a class C felony.
Her guilty plea was accepted Dec. 16 in Jay Circuit Court and she was sentenced to four years in the Indiana Department of Correction, with three years suspended and credit for time served since Sept. 15. She was ordered to pay $164 in court costs.
This case will be served concurrent to another in Blackford Circuit Court.
She was arrested Sept. 15 on a warrant. The prescription was filled April 12.
Sixth denied
A former Portland man’s sixth request for his sentence to be modified recently was denied in Jay Circuit Court.
Michael Irelan, 23, who currently is in prison in Greencastle, asked for his sentence to be modified. His request was denied Dec. 15.
He was sentenced July 6, 2009 to 10 years in prison, with credit for 122 days served, on a charge of burglary, a class B felony.
Trial scheduled
A jury trial has been scheduled for a Portland man accused of cutting his girlfriend’s neck.
Steven D. Gannon, 44, is facing a charge of battery by means of a deadly weapon, a class C felony. His two-day Jay Circuit Court jury trial is scheduled to begin March 10 at 8:30 a.m.
He was arrested Sept. 15 after he allegedly cut the woman with a knife.
Third denied
A former rural Pennville man’s request to have his sentence modified recently was denied in Jay Circuit Court.
Dustin Fox, 20, who currently is in prison, asked to be placed on work release. His request was denied Dec. 2.
He was sentenced June 22 to 10 years in prison, with six years suspended, on a charge of dealing in a schedule II controlled substance, a class B felony.
Pleads to possession
A rural Pennville man is scheduled to be sentenced next month on a felony charge.
Dustin R. Sapp, 26, pleaded guilty Nov. 30 to possession of marijuana, a class D felony. Sentencing is set for Jan. 11 at 11:30 a.m. in Jay Superior Court.
He was arrested April 19 after he was pulled over by Portland police for speeding. Police found marijuana in the console of his car.
Possession sentence
A Muncie man has been sentenced to jail time for possessing marijuana.
Joshua A. Hiatt, 27, pleaded guilty to possession of marijuana, a class D felony.
His guilty plea was accepted Dec. 15 in Jay Superior Court and he was sentenced to 18 months in the Jay County Jail, with all but 18 days suspended.
He was fined $50 and ordered to pay $164 in court costs, a $200 drug abuse, prosecution, interdiction and correction fee and a $400 Jay Superior Court Substance Abuse Program fee.
He was placed on probation for 17 months and his driver’s license, existing motor vehicle registrations and ability to register motor vehicles were each suspended for six months. If he successfully completes probation his conviction could be reduced to a class A misdemeanor.
He was arrested May 15 after he was pulled over by Dunkirk police for failing to dim his headlights. Police found marijuana under the front seat of the vehicle.
Pleads to DWI
A rural Portland man is scheduled to be sentenced in February for driving while intoxicated.
Stanley L. Smith, 57, pleaded guilty Dec. 14 to driving while intoxicated, a class D felony. Sentencing is set for Feb. 8 at 11 a.m. in Jay Superior Court.
He was arrested Aug. 9, 2009, after he was pulled over by Jay County police for driving on the wrong side of the street.
Driving while intoxicated, normally a misdemeanor charge, is enhanced to a class D felony if the person has been convicted of DWI in the last five[[In-content Ad]]
