Sentenced on two
A Portland man was recently sentenced after he pleaded guilty to felony and misdemeanor charges.
Johnathan E. Hicks, 28, pleaded guilty to possession of a controlled substance, a class D felony and possession of marijuana, a class A misdemeanor.
His guilty plea was accepted May 25 in Jay Superior Court. For the controlled substance charge he was sentenced to 18 months in the Jay County Jail, with all but six days suspended and six days credit for time served. He was ordered to pay $164 in court costs, a $200 drug abuse, prosecution, interdiction and correction fee and a $400 Jay Superior Court Substance Abuse program fee.
For the other charge he was sentenced to one year in the Jay County Jail, with all but six days suspended and six days credit for time served. He was placed on probation for 17 months.
If he successfully completes probation, his felony conviction could be reduced to a class A misdemeanor.
Hicks was arrested Feb. 28 after he was pulled over by police for failing to use a turn signal.
Pleads to forgery
A Portland man has pleaded guilty to using a stolen check to purchase pizza.
Todd Stewart, 28, recently pleaded guilty in Jay Circuit Court to forgery, a class C felony. The next hearing in his case is scheduled for June 30 at 2 p.m.
Portland police arrested him on a warrant on March 23. On March 13, he used someone else's check without his permission to purchase pizza and signed the man's name on the check.
If his guilty plea is accepted, a charge of theft, a class D felony, will be dismissed.
Misconduct trial set
A two-day jury trial for a Dunkirk man accused of having sex with a 15-year-old girl has been scheduled.
Joseph T. Pohl, 21, is facing three counts of sexual misconduct with a minor, all class B felonies. His Jay Circuit Court jury trial is scheduled to begin July 29 at 1 p.m.
He is accused of having inappropriate sexual contact with the girl in December of 2009, on Feb. 5 and on Feb. 12. He was in a relationship with the alleged victim.
Request denied
A former Portland resident's second request to have his sentence modified has been denied in Jay Circuit Court.
The request by Francisco Brown, 26, who is serving his sentence at the Miami Correctional Facility, Bunker Hill, was denied May 26.
Brown had asked to be accepted into the community transition program.
He was sentenced Nov. 22, 2002, on charge of child molesting, a class B felony, to nine years in prison, with credit for time served since June 21, 2002.[[In-content Ad]]
