Felony court news

Modification denied

A request made by a Redkey man serving a sentence for selling methamphetamine, recently was denied in Jay Circuit Court.

Joshua E. Johnson, 32, asked for his remaining sentence to be reduced or suspended. His request was denied Oct. 27.

Johnson was sentenced June 26 on a charge of dealing in methamphetamine, a class B felony. He was sentenced to 10 years in the Indiana Department of Correction, with 356 days credit.

Sentenced for

theft attempt

A Dunkirk man recently was sentenced for attempting to use a stolen debit card at an ATM machine.

Cameron W. Besser, 20, pleaded guilty in Jay Superior Court to attempted theft, a class D felony.

His guilty plea was accepted Oct. 26 and he was sentenced to 18 months in the Jay County Jail, with all but 10 days suspended and 10 days credit for time served.

He was fined $100 and ordered to pay $164 in court costs. He also was ordered to perform 60 hours of community service and was placed on probation for 17 months. If he successfully completes probation, his conviction may be reduced to a class A misdemeanor.

Jay County police arrested him on a warrant on Aug. 17. The crime occurred July 19.

Sentenced for

nonsupport

An Ohio man recently was sentenced to jail time for failing to pay child support.

Jose Schwartz, 43, Lancaster, pleaded guilty to nonsupport of a dependent child, a class D felony. His guilty plea was accepted Oct. 26 and he was sentenced to three years in the Jay County Jail, with two-and-a-half years suspended and 180 days credit for time served.

He was ordered to pay $164 in court costs and $12,915.76 in restitution to Rhonda McCain and/or Alexander Johnson. He was placed on probation for three years. The conviction may be reduced to a class A misdemeanor if he successfully completes probation.

Jay County police arrested him on a warrant on Aug. 20.

Sentenced for entry

A Portland man recently was sentenced for entering another person's home.

Phillip A. Ferguson, 44, was found guilty by a Jay Superior Court jury on July 23 of residential entry, a class D felony, and trespass and battery resulting in bodily injury, both class A misdemeanors. He also was declared a habitual offender.

He was sentenced Oct. 20.

For the residential entry charge he was sentenced to two years in the Indiana Department of Correction, with 100 days credit for time served. He was ordered to pay $164 in court costs.

For the battery charge he was sentenced to one year in prison, with the sentences being served consecutively.

For being a habitual offender, he was sentenced to four years in prison, served consecutively to his other sentences. He was not sentenced on the trespass charges.

Ferguson was arrested Jan. 17, 2008, by Portland police, after he entered a Portland man's home, punched him several times on the face and refused to leave.

Pleads to DWI

A Pennville man has pleaded guilty to a charge of driving while intoxicated, a class D felony.

Anthony E. Hill, 40, pleaded guilty Oct. 20 in Jay Superior Court. He is scheduled to be sentenced Jan. 5 at 9 a.m.

He was arrested Feb. 2 after he was involved in a domestic dispute in the parking lot of West Jay Middle School. Police pulled him over on Ind. 167, near county road 200 South.

Rejected

A rural Winchester man's request to have his sentence modified recently was denied in Jay Superior Court.

Steven E. Limbert 32, asked to serve his remaining sentence on home detention or weekends. His request was denied Oct. 26.

Limbert was sentenced Aug. 11 on a charge of theft, a class D felony. He was sentenced to two years in the Jay County Jail, with all but 12 months suspended and two days credit.

Found guilty

A rural Portland man recently was found guilty by a Jay Superior Court jury.

Gary D. Brewster, 41, was found guilty Oct. 21 of theft and obstruction of justice, both class D felonies. He is scheduled to be sentenced Dec. 15 at 9 a.m.

On Feb. 16, he stole a written witness statement in connection with an incident at West Jay Middle School. Jay County police arrested him on a warrant on March 4.[[In-content Ad]]
