Christopher Summers, a former Fort Recovery Local Schools teacher found guilty of sexually assaulting a student, filed another appeal Nov. 23.
Summers, who is serving a 21-year sentence, appealed to the Third District Court of Appeals in Lima, saying Mercer County Common Pleas Court was in error in denying his post-conviction relief petition. In the petition, he claimed his counsel had been ineffective in advising him on a plea agreement.
But Mercer County Common Pleas Court Judge Jeffrey Ingraham pointed out in his ruling that if Summers hadn’t taken the plea agreement, he likely would have been found guilty of more crimes and ended up with a longer sentence.
Summers has previously appealed unsuccessfully on other grounds to the appeals court and to Ohio Supreme Court.
