Felony court news

Probation violation
An Albany woman was found in violation of her probation Friday in Jay Superior Court.
Lindsay Wesley, 27, was sentenced to serve an additional 120 days of the original 18-month sentence imposed in addition to the 146 days remaining from the original sentence in the April 2014 case of possession of a controlled substance, a Class D felony.
She violated her probation in the case when she tested positive for methamphetamine and methadone.
She was given 36 days credit for 18 days served and will serve the remaining sentence on electronically monitored home detention.

Conversion sentence
A Portland man was recently sentenced in Jay Superior Court.
Jordan LeMaster, 20, pleaded guilty to conversion, a Class A misdemeanor, as an included offense of the charge of theft, a Class D felony, and was sentenced to one year in Jay County Jail, with all but 92 day suspended. He was given two days credit for one day served and will serve the remaining 90 days on electronically monitored home detention. He was assessed court costs of $168 and placed on formal probation for nine months.

Trials set
A Pennville man had two separate trials set Jan. 26 in Jay Circuit Court.
Paul Bennington, 52, will stand trial at 8:30 a.m. April 9 for two counts of dealing in methamphetamine, both Class B felonies.
He is also scheduled for trial at 8:30 a.m. April 23 for charges of dealing in methamphetamine, a Level 4 felony, unlawful possession of syringe, a Level 6 felony, possession of methamphetamine, a Level 6 felony, and possession of chemical reagents or precursors with intent to manufacture a controlled substance, a Level 6 felony.

Probation violation
An Albany man was found in violation of his probation Jan. 22 in Jay Circuit Court.
Joseph Batio, 24, was sentenced to an additional three years of the original sentence in the November 2010 case of dealing in a schedule III controlled substance, a Class B felony. He violated probation when he pleaded guilty Aug. 5 to visiting a common nuisance, a Class B misdemeanor.
He was given credit for time served from Dec. 17.

Non-support sentence
An Alabama man was recently sentenced in Jay Circuit Court.
Robert Prince, 38, Birmingham, Alabama, pleaded guilty to non-support of a dependent, a Class C felony, and was sentenced Jan. 21 to four years in Jay County Jail, with all but six months suspended. He was given credit from his date of arrest on March 10 and was assessed court costs of $168. He was ordered to pay $14,150.09 in restitution and was placed on formal probation for three years and six months.
