Cook, 53, Dunkirk, operating a vehicle while intoxicated, a Class C misdemeanor — Sentenced to 60 days in Jay County Jail with all but 22 days suspended, given two days credit for one day served, assessed court costs of $183.50, ordered to pay an alcohol and drug countermeasures fee of $200 and a substance abuse program fee of $400 and placed on formal probation for 11 months. As part of a plea agreement, a charge of operating a vehicle with an alcohol concentration equivalent of 0.08 percent or more was dismissed.
Pedro S. Vargas, 44, Portland, operating a vehicle with an alcohol concentration equivalent of 0.15 percent or more, a Class A misdemeanor — Sentenced to one year in Jay County Jail with all but 30 days suspended, given two days credit for one day served, with the remaining 28 days to be served on electronically monitored home detention, assessed court costs of $183.50, ordered to pay an alcohol and drug countermeasures fee of $200 and a substance abuse program fee of $400 and placed on formal probation for 11 months. The court recommended to the BMV a 180-day license suspension.
