Dealing schedule I
A Dunkirk woman was recently sentenced in Jay Superior Court.
Alicia Miller, Dunkirk, pleaded guilty to dealing in a schedule I controlled substance, a Class B felony. She was sentenced to 14 years in Indiana Department of Corrections, with all but eight years suspended and was placed on probation for period of eight years. She was given credit for time served since April 4, 2016, with a loss of three days earned good time. She was assessed court costs of $183, fined $200 for drug abuse, prosecution, interdiction and correction fee and ordered to pay restitution to Portland Police Department of $169.
Dealing narcotics
Luke N. Hamilton, 26, pleaded guilty in Jay Circuit Court to dealing in a narcotic drug, a Level 5 felony. As part of a plea agreement, a second count of dealing in a narcotic drug was dismissed. Hamilton was sentenced to three years in Indiana Department of Corrections, concurrent with a previous conviction, with one year of his sentence suspended and given credit from date of arrest, April 20, 2016. He was assessed court costs of $183, $200 DAPIC fee, $400 Jay Superior Court Substance Abuse fee and ordered to pay restitution to Portland PD of $167.50. He will be placed on formal probation for a period of one year.
Dealing
Shaun P. Woodring, 37, pleaded guilty in Jay Circuit Court to a charge of dealing methamphetamine, a Level 5 felony. As part of a plea agreement, a second count of possession of methamphetamine, level 6 felony, and third count of possession of chemical reagents or precursors with intent to manufacture a controlled substance, a level 6 felony, were both dismissed.
Woodring was sentenced to three years in Indiana Department of Corrections, and given credit since his date of arrest June 1, 2016. He was assessed court costs of $183 and a $200 drug abuse, prevention, interdiction and correction fee.
Child battery
Heather M. Teal, Portland, pleaded guilty in Jay Circuit Court to a charge of battery on a person less than 14 years old, a Level 5 felony. She was sentenced to Indiana Department of Correction for a period of three years, with one year of her sentence suspended. Teal was given credit from the date of arrest on April 11, 2016 through July 11, 2016, less two actual days loss of good time credit. Teal was assessed court costs of $183 and a $100 Child Abuse Prevention fee. She will be placed on formal probation of one year following release.
Child molesting
Jonah Tankersly pleaded guilty in Jay Circuit Court to child molesting, a Level 4 felony. He was sentenced to six years in Indiana Department of Correction, with two years suspended and given one day credit for time already served. He was assessed court costs of $183 and fined $500 sexual assault victims assistance fee.
Forgery and theft
Robert D. Cooper, 21, Portland, pleaded guilty in Jay Superior Court to forgery, a Level 6 felony, and theft, a Level 6 felony. For the forgery charge, he was sentenced to one year in Jay County Jail, to be served consecutive to the other sentence, with all but eight months of the sentence suspended. Cooper will receive day for day good time credit. He was fined a sum of $800 and assessed court fees of $183. He will be placed on probation for a period of four months following the end of previous probation. For the theft charge, he was sentenced to 18 months in Jay County Jail, consecutive to his forgery sentences, with all but 180 days suspended. He was given 178 days good credit for 89 already served. Cooper will receive day for day good time credit his remaining two days, and will serve his remaining time on Aug. 21. He was fined $100, $150 for Moral Recognition Therapy and assessed $183 in court costs. He will be placed on probation for one year.
Operating
Richard A. Harvey, 52, pleaded guilty in Jay Superior Court to operating a vehicle after forfeiture of license for life, a Level 5 felony. As part of a plea agreement, a charge of operating a vehicle while intoxicated was dismissed. He was sentenced to three years in Indiana Department of Corrections and given credit for three days already served. He was assessed court cost of $183.50. Court recommends to the Bureau of Motor Vehicles that his license be suspended for life.
Syringe possession
James C. Drayton, Jr., 22, pleaded guilty in Jay Superior Court to unlawful possession of a syringe, a Level 6 felony. He was sentenced to 196 days in Jay County Jail and given 196 days credit for 98 days already served. He was also assessed court costs of $183.
Probation violations
Dennis Emery was found by Jay Superior Court to have violated the terms of his probation, from a previous charge of dealing methamphetamine, a class B felony. He was sentenced to two additional years in Indiana Department of Correction and given credit for time served since May 16, 2016. His sentence will be served consecutive to his previous charge. He will remain under supervision of Jay County Probation Department upon release.
Teresa N. Allen was found by Jay Superior Court to have violated the terms of her probation, which stemmed from a previous charge of dealing a schedule II controlled substance, a class B felony. She was sentenced to two years in Indiana Department of Correction and given credit for time beginning July 12, 2016. She will be returned to probation upon release.
Teletha Roach was found by Jay Superior Court to have violated the terms of her probation after a previous conviction for dealing schedule III controlled substance, a class B felony. She was sentenced to two years of her previously suspended sentence in the Indiana Department of Corrections and given credit for time served since July 27, 2016. She will be discharged from probation unsatisfactorily after release.
Angela Franks was found by Jay Superior Court to have violated the terms of her probation, from a previous conviction of dealing a schedule III controlled substance, a class B felony. She was sentenced to four years in Indiana Department Of Corrections and given credit from the date of her arrest, May 4, 2016. Her probation will be terminated upon release from prison.
