Public Notice SECTION 001113 – ADVERTISEMENT FOR BIDS PART 1 – GENERAL NOTICE TO BIDDERS Notice is hereby given that sealed bids will be accepted by Town of Redkey (hereinafter referred to as the “Owner”) for the construction of the following Project: Redkey Fire Station. Bids will be received until: 12:10 (PM). local time, March 8, 2016, in sealed, plainly labeled envelopes with the Bidder’s name and return address at the following location: Redkey Fire Station C/O Jay County Community Development Corporation 118 South Meridian Street Portland, Indiana 47371 Bid opening will be held at 12:25 (PM) local time, March 8, 2016, at Jay County Community Development Corporation offices, 118 South Meridian Street, Portland, Indiana 47371. All bidders and interested citizens are welcome and encouraged to attend the bid opening. Should any citizen require special provisions, such has handicap modifications, or non-English translation, please request such provisions by March 1, 2016. Bids received after that time will be returned unopened. Work shall be performed under a Unified Contract. Bids shall be submitted on forms as indicated by Section 004113, “Bid Form – Stipulated Sum,” of this Project Manual. Bids must be accompanied by either a Bid Bond or a certified check in the amount of five percent (5%) of the total Bid (including all add alternates) made payable to the following: Town of Redkey. All bid proposals, Forms 96 (current revision), or other documents related to this bid must be completed, signed, and notarized where indicated. Section III of Form 96 mandates each bidder to furnish a copy of the company's financial statement with the bid. Bidders are required to furnish appropriate forms and statements. Failure to furnish and complete these forms and statements may cause the bid to be rejected. The successful bidder is required to submit an executed contract and a certificate of insurance to the Owner within five (5) days of receipt of the contract from the Architect or Owner. Failure to execute and submit the contract and certificate of insurance may result in forfeiture of bid security to the Owner as liquidated damages. Refer to Section 002213, “Supplemental Instructions to Bidders,” for additional information. Construction shall be in full accord with Drawings and Specifications. To obtain bidding documents, please log on to www.easternengineerng.com or call Eastern Engineering Supply at (317) 598-0661. After submitting the plan fee in the form of a check or money order made payable to the Owner, Town of Redkey, and received by Eastern Engineering Supply, 9901 Allisonville Road, Fishers, Indiana 46038, bidders may obtain bidding documents. If the bidders request, documents will be forwarded from Eastern Engineering Supply via UPS, Federal Express, or courier service if preferred. The bidder must include their shipper account number along with their deposit check. The bidder will be billed directly for this delivery. General Contractors, Subcontractors and Suppliers may obtain sets upon receipt of a $150.00 plan fee for each complete set of Bid Documents. The plan fee is not refundable. Bid Documents may be examined by prospective Bidders 8 (AM) and 4:00 (PM) at the following location: Jay County Community Development Corporation 118 South Meridian Street Portland, Indiana 47371 The Contractor receiving the award shall furnish approved one hundred percent (100%) Performance and Payment Bonds which cover faithful performance of the Contract and the payment of all obligations arising from the Contract. Said bonds shall remain in full force and effect for twelve (12) months from the date of final acceptance of the Work. Brand names, trade names and/or manufacturers’ names are used in this Project Manual solely for the purpose of establishing kind and quality and not for the purpose of limiting competition. 1. Bidder may offer other items or materials equal in quality and having the same durability and efficiency as those specified if the Bidder first receives written approval from the Architect/Engineer before the Bid opening in compliance with the requirements stipulated in the Instructions to Bidders. 2. The Bidder shall identify any such substitutions by name, kind, and/or type with the Bid. The Owner reserves the right to accept or reject any Bid and to waive any informalities or errors in Bidding. 1. Base Bid may be held for a period not to exceed sixty (60) days before awarding Contract. 2. All Alternate Bids may be held for a period not to exceed sixty (60) days after signing of Contract 3. Any bidder withdrawing its bid within the sixty (60) day period may forfeit its bid security at the discretion of the Owner. Wage Scale: As required by the Federal Davis Bacon Act, a minimum wage has been determined for this Project and is on file at the office of the Owner. Contractor shall pay the minimum wage rates as established by this Wage Scale. Said Wage Scale is a part of this Contract and is incorporated herein as fully as if here set forth. All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the project throughout. Each Bidder is responsible for inspecting the Project site(s) and for reading and being thoroughly familiar with the Contract Documents and Specifications. The failure or omission of any Bidder to do any of the foregoing shall in no way relieve any Bidder from any obligation with respect to its Bid. The Bidders attention is also called to the Minority/Women Business Participation requirements contained in the Project Specifications. The Office of Community and Rural Affairs has adopted a State goal of 10% participation for minority and female owned businesses for construction related or purchase related contracts for the work. In addition, the Contractor must meet guidelines and practices established by the Office of Community and Rural Affairs and appropriate Federal regulations including: 1) Executive Order 11246, 2) Section 3 of the Housing and Community Development Act of 1968, as amended, 3) Certification of Non-Segregated Facilities, 4) OMB Circular A-102, 5) Title VI of the Civil Rights Act of 1964, 6) Section 504, Rehabilitation Act of 1973, 7) Age Discrimination Act of 1975, 8) Executive Order 12138, 9) Conflict of Interest Clause, 10) Retention and Custodial Requirements for Records Clause, 11) Contractors and Subcontractors Certifications, and others that may be appropriate or necessary. In addition, the Contract Division procurement is subject to the Federal Regulations contained in the OMB Circular A-102, Sections B and O and the State of Indiana requirements contained in IC-36-1-9 and IC-36-1-12. Any contract(s) awarded under this Advertisement for Bids are expected to be funded in part by a grant from the Department of Housing and Urban Development, as administered by the Office of Community and Rural Affairs through its Community Focus Fund Program. Neither the United States nor any of its departments, agencies or employees is or will be a party to this Advertisement or Bids or any resulting contract. A conditional or qualified Bid will not be accepted. Award will be made to the lowest, responsive, and responsible bidder.
