Common nuisance
Haley M. Franklin, 23, Dunkirk, was found guilty of maintaining a common nuisance, a Level 6 felony. She was sentenced to 180 days in Jay County Jail to be served consecutive to the sentences imposed after a conviction of dangerous control of a firearm, a Level 5 felony, and theft, a Level 6 felony, given 22 days credit for 11 days served, ordered to serve the remaining 158 days of her sentence, which began May 23, and receive day for day credit and assessed court costs of $183. As part of the plea agreement, the charge of possession of a syringe was dismissed.
She also violated the terms of her probation originally imposed March 24, 2015 after a conviction of theft, a Level 6 felony. She was sentenced to an additional 60 days of her two and a half year sentence to be served consecutive to the Level 6 and Level 5 felony charges, ordered to serve the additional 60 days in Jay County Jail beginning Aug. 10, 2016 and receive day for day credit.

Dallas Wilburn, 28, Avon, was found guilty of dealing in methamphetamine, a Level 5 felony. He was sentenced to five years in the Indiana Department of Corrections to be served consecutive to the sentence imposed in two pending charges out of Delaware Circuit Court for dealing in a narcotic drug-manufacture or deliver or finance the manufacturing or dealing of a schedule I or II narcotic, both Level 5 felonies, with all but one and a half years suspended, given credit for time served from Sept. 24, 2015 to Nov. 10, 2015 and April 18, 2016 to the present, assessed court costs of $183, ordered to pay a drug abuse, prosecution, interdiction and correction fee of $200 and substance abuse program fee of $400 and placed on formal probation for three and a half years. As part of the plea agreement, the charges of possession of methamphetamine, possession of chemical precursors with the intent to manufacture a controlled substance and unlawful possession of a syringe were dismissed.

Robin K. Jacks, 43, Portland, was found guilty of dealing in a narcotic drug, a Level 5 felony. She was sentenced to four years in the Indiana Department of Corrections, given credit from the date of her arrest on Feb. 3, 2016, assessed court costs of $183, and ordered to pay a drug abuse, prosecutions, interdiction and correction fee of $200.
