Sentenced
Benjamin E. Vance, 23, Portland, operating a vehicle with an alcohol concentration equivalent of .08 percent or more, a Class C misdemeanor — Granted conditional discharge for one year. The court found alcohol was a material element of the offense and that proper intervention would decrease his engagement in antisocial behavior. A count of operating a vehicle while intoxicated, a Class C misdemeanor, was dismissed. If he follows conditions of the discharge, the court will dismiss the charge against him. The conditions include not committing another criminal offense; completing substance abuse program; paying a substance abuse program fee of $400; not purchasing, consuming or possessing alcoholic beverages; and performing 40 hours of community service work. The court also recommended Indiana Bureau of Motor Vehicles suspend his driving privileges for 90 days, which began June 30.
Kevin Vanskyock, 43, Portland, battery resulting in bodily injury, a Class A misdemeanor, probation violation — Sentenced to an additional 90 days of the 180 day original sentence, after he allegedly consumed alcohol at Pete’s Duck Inn and Pit’s Bar in February. He received two days credit for one day served and will serve the remaining 88 days on electronically monitored home detention.
Tyler Mills, 28, Portland, operating a vehicle with an alcohol concentration equivalent of .15 percent or more, a Class A misdemeanor — Sentenced to one year in Jay County Jail, with all but two days suspended. As part of a plea agreement, a count of operating a vehicle while intoxicated was dismissed. He was given two days credit for one day served and was assessed court costs of $168.50. He was ordered to pay a $200 alcohol and drug countermeasures fee and a $400 substance abuse program fee. He was placed on formal probation for 11 months, and the court recommended Indiana Bureau of Motor Vehicles suspend his driver’s license for 90 days, which began pre-conviction on June 23.
