Commissioners hear CFO complaints (10/08/07)

Two Jay County residents appealed to commissioners Monday for help with controlling odors caused by confined feeding operations.

Judith McIntire said this morning that an operator of a CFO recently left manure on a field she owns for nearly a week near her house, which is located at 3752 West 350 South in Jefferson Township.

Commissioners Gary Theurer and Faron Parr fielded the comments. Commissioner Milo Miller Jr. was not present at this morning's meeting of the commissioners.

McIntire said the smell from the waste drew insects in and left her home "inundated with flies."

She showed Theurer and Parr photographs of flypaper rolls covered with flies that hung from the ceilings of her home.

"It wasn't just an odor, it was a stench," she said, adding that it was difficult to eat because the smell was so strong inside and outside her residence. "It was horrible out there.

"We had fly swatters going all the time. It was nasty."

McIntire told commissioners that she spoke with the Indiana Department of Environmental Management about the issue.

She said that a spokesperson from IDEM told her it could not do anything about the problem unless it affected water supplies, and that county commissioners were the first line of defense to enact regulations countering hazards posed by CFOs.

"It's your job to help us," she said to commissioners.

Theurer said the county has worked to resolve problems by creating greater setback requirements for new operations.

Citing Theurer's background as a CFO operator, McIntire said she believes a "conflict of interest" may exist with decisions coming from commissioners regarding livestock operations.

Joe Gutshall, 723 South 1100 West, said he also was concerned about disease and other health hazards brought on by waste lagoons and flies at large livestock operations.

Parr and Theurer said options are limited in what commissioners can do to curb odors.

They told the residents that as long as the operations meet setback requirements they cannot be stopped from building in Jay County.[[In-content Ad]]
