Conditions set on requests to re-zone parcels (01/06/06)

Two locations earmarked for potential future businesses have moved a step closer to being re-zoned — but not without stipulations.

The lots — one located on Portland’s west side and the other located north of Portland — currently are zoned agricultural. The owners of the parcels asked the Portland Planning Commission Thursday to consider rezoning the lots as highway service.

Highway service zoning would allow a wide variety of commercial operations.

Commission members voted to recommend the Portland City Council rezone the lots with stipulations. Both property owners must submit development plans to the commission within a year. One also must figure out how to provide water and sewer services.

One parcel is located on the north side of West Votaw Street, adjacent to Ja-mar T.V. Appliances and Bedding.

The 80-acre lot is owned by local real estate agent Mel Smitley. He is asking the lot be rezoned to make it easier to market the property. No one has committed to developing the property, Smitley said.

Smitley said Thursday the process “will move along a lot quicker if it’s already rezoned.”

Bill Milligan, Jay/Portland Building and Planning administrator, said the Portland Zoning Ordinance states that plans for any highway service lot more than a quarter of an acre in size must be submitted to the planning commission for approval before construction can begin.

He suggested the ordinance to rezone the land state that the final plans must be submitted within a year of rezoning, or the lot reverts back to being zoned as agricultural.

Commission members decided to recommend the council rezone the land with the condition suggested by Milligan.

A request by Keith Osterholt to rezone 2.69 acres located at 1885 North U.S. 27 was sent to the city council with the same stipulation, plus an additional condition.

Osterholt hopes to construct a 60 x 120-foot steel building on the lot to house a recreational vehicle sales and repair business.

Milligan said Osterholt would either need to run city water and sewer lines to the business or install a septic system. If Osterholt decides to install a septic system, he would need to get permission from the Portland Board of Zoning Appeals because the change would be considered a variance from developmental standards, Milligan said. Most projects abide by the standards by using the city’s water and sewer lines.

The commission decide to add a stipulation to the rezoning motion which states Osterholt must also decide how to provide water and sewer service within a year, or the lot will revert back to being zoned as agricultural.

Also Thursday, commission members:

•Re-elected Vicki Tague as president, Dolphus Stephens as vice president and Judy Aker as secretary.

Member Lee Newman was re-appointed as the commission’s representative on the Jay County Planning Commission.[[In-content Ad]]
