Family asks for prayers as hearing approaches (11/19/07)

To the editor:
This is just a note to let you all know that on Tuesday (Nov. 20) at 11 a.m. we will be attending a hearing in court over the death of my son Brandon. It has been over four years now that we have been fighting this to obtain what we feel is justice. This hearing will determine if this will finally go before a jury trial or not. If the judge denies us this request, then our fight is over. If he rules in our favor (for it), then it will be heard before a jury.
We have had a tough battle. We feel evidence was destroyed that we hoped to obtain that was in fact ordered to held by the court. We were also told the police car involved was "disposed of."
A couple of witnesses that we had spoken with have disappeared - just moved away or something with no forwarding address and so forth. If you remember we hired a accident reconstructionist and a Intergraph company out of Florida to enhance the video tape that came out of the second officers car, being the first officer involved in the pursuit said he didn't have his video cam on because he was unaware that it was working. In short, both hired professional's statements conflicted with the officer's statement.
With all of this, we need prayer for true judgment and for God to be in the midst of that courtroom Tuesday.
No matter what happens, Brandon is gone. We have done all we knew to do to prove our beliefs with what we had been given. We have fought all we knew how to bring some form of justice for him.
Some things have been done thanks to the new mayor and elected officials that year. From what I understand a new pursuit policy was written or upgraded as an example as to why this or that should and shouldn't be done. Hopefully if this is true, it will benefit the community in whole in future pursuits.
The officers involved resigned. Things have changed for the better. But on our end our hearts will always be broken. We have lost a part of us and the pain to this day is sometimes unbearable. Hopefully when this is all over, we will have closure and my son's name can finally rest in peace.
