Firm gets variance for building (04/11/07)
Portland Board of Zoning Appeals

A variance request for a Portland business has been approved.
Pennville Custom Cabinetry president Mark Goldman asked for a variance in the rear yard setback requirements so he could construct a storage building to house paint supplies.
The request was approved by members of the Portland Board of Zoning Appeals on Tuesday.
The addition to the 600 E. Votaw St. business will be located near the south side of Pearl Street near the northeast corner of the existing production facility.
The city's zoning ordinance requires structures to be at least 5 feet from a right-of-way. The proposed storage building would be 6 feet within the right-of-way, and about 6 feet from the street, said Jay/Portland Building and Planning administrator Bill Milligan.
The right-of-way for Pearl Street is 49.5 feet, Milligan said this morning.
Milligan said after the meeting that the building will not create any traffic problems.
He received no verbal or written opposition to the project.
Board president Ken Walters, and board members Vicki Tague and Larry Petro voted in favor of the request during the four-minute meeting. Board members Ron May and Susan Schutz did not attend.
Also Thursday, board members approved the BZA guidelines.
The guidelines state that when the board members consider requests they should make sure that the projects will not be injurious to others, will not adversely affect other properties, will not result in hardship to the property and observes the spirit of the zoning ordinance.
The board also may not grant a special exception or variance in a Flood Plain District without permission from the Indiana Department of Environmental Management, and should make sure that projects do not interfere with the city's comprehensive plan.
