Jay reassessment is ordered (09/24/07)

The Indiana Department of Local Government Finance has ordered a reassessment for industrial and commercial properties in Jay County.

The confirmation came Friday.

County commissioners discussed information provided to them this morning as part of their weekly meeting.

The mandate was given in light of a public hearing held by DLGF officials on Sept. 14 to debate the need for a reassessment. It was held to examine the low rates of change in values of commercial and industrial properties.

"We pretty much knew at the hearing this was going to happen," Commissioner Gary Theurer said.

Jay County's assessor must perform a reassessment for "the purposes of detecting and correcting undervalued and omitted properties," according to a directive issued by DLGF. The review of properties, including adjustments in property values, must be completed by Dec. 31.

The assessor's office is to use information from 2005 to calculate changes in property values from 1999 to 2005, the directive said.

DLGF also said in its statement that Jay County's 2008 budget would not be accepted until information from the reassessment is completed, provided to the state and approved by DLGF.

Commissioner Milo Miller Jr. said the county was not happy with the order to reassess commercial and industrial properties but is ready to comply.

"I suppose we'll sit back and see what happens," Miller said.

Late this morning, the commissioners were discussing the ordered reassessment with Jay County Assessor Anita Mills.

Also today, commissioners said they need to review more information before making a decision on a recommendation made last week by the Jay County Planning Commission.

The recommendation, which the planning commission unanimously approved Thursday, would require new livestock operations - regardless of size and animal populations - to meet the same setback requirements as all confined feeding operations.

Setback requirements refer to a combination of distance and location of a livestock operation, according to Jay Planning.

The current ordinance that covers setbacks and other information for CFOs and Concentrated Animal Feeding Operations says the operations must be at least 750 feet from the nearest residence not owned by the operator. Facilities must also be at least 100 feet from the road.

Additional setback requirements exist for facilities in locations near schools, churches and in areas zoned for business other than agriculture.

Previously, the ordinance regulating setbacks contained a definition for "confined feeding facility" that had requirements for the number of animals necessary for an operation to qualify for setback requirements. The planning commission voted to add a definition for "confined feeding," which states that animals fed by other means than grazing in new livestock operations must meet the same requirements as larger operations.

Commissioners must approve the move before taking effect.

Commissioners' attorney Brad Burkett advised that commissioners should carefully review the recommendation before making a decision. He said the repercussions of adding the "confined feeding" definition could end up "opening up a can of worms."
