Trustee for TIF is OK'd (05/15/07)

In a couple of final steps in setting up the county's tax increment financing (TIF) district, members of Jay County's Redevelopment Commission approved authorizing a trustee to oversee the use of the funds, if needed.
Sue Beesley, of Bingham-McHale LLP, consulting attorney, for the TIF development, told commission members it was "a clean-up step" that was not included in the original bond ordinance.
That ordinance allows the trustee to execute any of the trusts or powers and perform any of the necessary duties pertaining to paying off the bonds, Beesley explained.
Additionally, the commission passed a resolution pledging the TIF monies for the sewer development project.
The county established the TIF in November after a request from Poet Biorefining - Portland (formerly Premier Ethanol), to help with the costs of infrastructure at the ethanol production site southwest of Portland.
Beesley told members that she is awaiting an order from Melissa Henson, commissioner of the Department of Local Government Finance approving the TIF.
Once that order is received, Beesley said closing on the tax exempt portion of the bonds could be completed in about three weeks.
That portion of the bonds, which will be sold first, pledges funds towards the county's costs for a portion of the sewer line connecting the ethanol production plant to Portland's Wastewater Treatment Plant.
Poet will be constructing the line to a site on the north side of the Salamonie River and the county will then be extending the line along county road 150 South to Blaine Pike where a lift station will carry sewage to the Portland wastewater treatment plant.
On Monday Jay County Commissioners awarded a contract to Lica Construction Corp. for $259,688.43 for the county's portion of the sewer line.
That cost is less than half of the engineer's estimate of $536,990.
"If we don't need that amount, we won't borrow that amount," Beesley said about cost. "We can't over-borrow. That's a good problem."
The taxable portion of the bonding - those funds that will go to Poet - will be finalized after the tax-exempt bonds are sold, Greg Guerrettaz, with FSG Corp., Indianapolis, has said.[[In-content Ad]]
