Notice of Amendments To The Jay County Ordinances Concerning Zoning Ordinance & Subdivision
Control Ordinance
The Jay County Plan Commission hereby give notice of a meeting to be held on November 13, 2014, at 7:00 pm in the Auditorium of the Jay County Courthouse, to consider the following proposed amendments to the Jay County Zoning Ordinance and the Jay County Subdivision Control Ordinance. The Jay County Plan Commission is the initiating party of the proposed amendments. The amendments in their entirety may be examined in the Plan Commission Office, Jay/Portland Building & Planning Department, 118 S Meridian Street, Suite E, Portland, Indiana, or in the Auditor's Office Monday through Friday from 8:30 am to 4:30 pm. Persons may offer an oral opinion at the hearing or submit written comments to the Plan Commission Office ten (10) days prior to the hearing. The hearing may be continued thereafter to a future date.
Amendments to the
zoning ordinance:
Article 2, Section 216.2, Subsection 2 is hereby amended to add the following:
2. All structures and confined lots designed to house or contain livestock shall be set back 1/2 mile (2,640 feet) from the corporate limits of Redkey and 1/2 mile (2,640 feet) from the corporate limits of Salamonia.
Article 2, Section 216.3, Subsection 2 is hereby amended to add the following:
2. All structures and confined lots designed to house or contain livestock shall be setback 1/2 mile (2,640 feet) from the corporate limits of Redkey and 1/2 mile (2,640 feet) from the corporate limits of Salamonia.
Article 4, Section 404, Subsection D is hereby amended to read as follows:
D. Any person or entity whether owner or possessor, who shall violate, or who permits or allows a violation, of any of the provisions of this Ordinance, or who fails to comply therewith or with any requirements there under, or who shall build, reconstruct, or structurally alter any building in violation of any detailed statement or plan submitted upon which an approval or grant is given under this Ordinance, shall, upon complaint filed in any court of the county and upon judgment finding such a violation, be fined not less than five hundred dollars ($500.00) nor more than twenty-five hundred dollars ($2,500.00) for a first violation. If said violation continues thereafter or in the event of any second or subsequent violation, a fine of not less than five hundred dollars ($500.00) nor more than seventy-five hundred dollars ($7,500.00) shall be imposed per day for such violation. Each day a violation continues shall be considered a second or subsequent violation.
The fines and penalties herein specified are imposed pursuant to Indiana Code Section 36-1-3-8 (a)(10).
