Jury returns guilty verdict


A Dunkirk man was found guilty Thursday of criminal recklessness resulting in serious bodily injury, a Class D felony, after shooting an alleged intruder to his home.
David McLaughlin, 32, was found guilty of the charge, which carries a standard 18-month prison term, in Jay Superior Court.
The charge stems from an early morning incident April 21 when McLaughlin was woken by his alarm system to someone breaking into an unattached garage on his property.
McLaughlin told officers he went outside carrying a .45 caliber handgun when a man ran out of the garage.

He allegedly told the man to stop, but the intruder continued to run and McLaughlin followed. McLaughlin allegedly fired three rounds in the pursuit, which went off of his property and into an alley. He told jurors the gunshots were a response to the intruder’s movements, which made him believe he had a gun of his own, reported The Star Press.
One shot hit the alleged intruder, David Bailey, 29, 211 N. Foster Ave., Albany, in the left arm. Bailey testified in court that he was shot but denied that he had broken into McLaughlin’s garage, according to The Star Press.
A sentencing hearing for McLaughlin has not been set.
Bailey is charged in Jay Circuit Court with burglary, a Class C felony.
